"Historically, few topics have proven to be so controversial in the international intellectual property arena as the protection of geographical indications (GIs). The adoption of TRIPS in 1994 did not resolve the disagreements on the issue, and countries world-wide continue to quarrel as to the nature and scope of protection of GIs internationally and nationally. In this context, several countries in Asia-Pacific have actively promoted GIs as a mechanism to foster local development and safeguard local culture, while others have been more skeptical as to the promises of GI protection. Yet thus far, there is little literature addressing GI protection from the point of view of the Asia-Pacific region. This book, edited by renowned intellectual property scholars, fills this void and offers a variety of contributions focusing on the framework and effects of GI protection in the Asia-Pacific region. From Seascapes of extinction to seascapes of confidence. Territorial Use Rights in Fisheries in Chile: El Quisco and Puerto Oscuro by Gloria Gallardo Fernandés is an important contribution to our understanding of the multifaceted challenges underlying sustainable solutions to ecological fisheries, the book describes how, in Chile, indiscriminate harvest of the edible shellfish Concholepas concholepas (false abalone or Loco), has been threatening not only the living of small-scale artisan fishers but also the ecosystem. In an attempt to strengthen the fishers' livelihoods and at the same time recuperate the fish, the Chilean government introduced the regulatory measure: Management and Exploitation Areas for Benthic Resources (MEABRs), locally known as Management Areas (MAs) and internationally as Territorial Use Rights in Fisheries (TURFs).

Examining fisheries, Brexit, the Trade and Cooperation Agreement (TCA) and its consequences for the Fishing Industry in the UK and the EU, this book explores key issues within the complex topic of fisheries after Brexit. Assessing the new fishing relationship between the UK and the EU, which will continue to develop over the next decade, it provides an important study of the state of fisheries post-Brexit. Taking a cross-cutting economic, legal and policy approach, the book outlines the social and economic impacts of Brexit on the UK and EU fishing industries. It critically analyses the provisions relevant to fisheries in the TCA, reflects on the bilateral fishing negotiations between the EU, UK and Norway, providing inferences as to what the "new and special relationship" might be in fisheries. It then focuses on the 2020 Fisheries Act and explores internal divergences in the nations of the UK because of devolution. Taking an international approach, the work offers an exploration of cooperation in fisheries enforcement, international and regional obligations in marine conservation, and the new horizons for the UK in international fisheries organizations and arrangements now it is no longer a member of the EU.
